Patrick Stokes is an associate of Hinkle, Jachimowicz, Pointer & Emanuel's employment law and civil litigation practices.
Patrick's practice is devoted primarily to representing employees in all types of cases including wage and hour, discrimination (including race, sex, age, national origin, sexual orientation, pregnancy, and disability), harassment, retaliation, wrongful termination, family and medical leave, breach of contract, and defamation.
Patrick brings a strong backgound in wage and hour law to the firm's existing employment practice. Patrick has a special interest in cases where employers attempt to avoid paying overtime wages by placing an employee on salary; he believes this to be the most common and least addressed form of employer misconduct. These cases also typically involve failure to pay straight time wages, failure to allow lawful rest breaks and meal periods, and failure to pay all wages due on termination of the employment relationship.
Patrick also provides advice and transactional support to both employees and employers. Patrick provides counseling to employees in understanding and negotiating employment contracts and separation agreements. Patrick also provides counseling to employers on such issues as employment policies, terminations, family and medical leave, employment contracts, and classification of employees.
In addition, Patrick has represented individuals in many other types of civil matters including police brutality, assault, battery, automobile negligence, and premises liability.
Prior to joining Hinkle, Jachimowicz, Pointer & Emanuel, Patrick was a certified law student with the Katharine and George Alexander Community Law Center, an intern at the San Jose office of the United States Equal Employment Opportunity Commission (EEOC), and worked at Joseph W McCarthy, a Law Corporation.
Prior to becoming an attorney, Patrick was a civil engineer in the field of underground construction. He worked on major tunnel construction projects in the states of California and Rhode Island.
